These Terms of Service ("Terms") govern your access to and use of the website at https://polished.cx/ and the related real-time voice AI services (the "Service") provided by Polished.CX ("Polished.CX," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- "You" / "User" means the person or entity using the Service.
- "Account" means your registered account on the Service.
- "Content" means audio, transcriptions, text, and other data you submit to or generate through the Service.
- "Output" means results produced by the Service's AI features, including localized audio, translated speech, and transcriptions.
2. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- An account is required to use the Service. You are responsible for the accuracy of your account information and for keeping your credentials confidential.
- You are responsible for all activity that occurs under your Account.
3. The Service and License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. We may modify, suspend, or discontinue any part of the Service at any time, and we will use reasonable efforts to give advance notice of material changes that adversely affect paying customers.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Process voice or conversation data without all legally required consents (see Section 5).
- Attempt to reverse engineer, scrape, or interfere with the Service.
- Use the Service to transmit unlawful, harmful, deceptive, or infringing content.
- Resell or provide access to the Service to third parties except as expressly permitted in a written agreement with us.
- Use the Service to impersonate another real person, to clone a specific individual's voice without that individual's consent, or to create deceptive or fraudulent audio (for example, scam calls, voice-phishing, or non-consensual deepfakes).
We may suspend or terminate access for violations.
5. Voice Processing and Consent Obligations
The Service processes spoken conversations, which may include the voices of people other than you (for example, customers or call participants).
You are solely responsible for:
- Determining the recording, monitoring, and processing laws that apply to your conversations, which vary by jurisdiction (including "one-party" vs. "all-party" consent rules).
- Obtaining and maintaining all legally required notices and consents from every participant before processing their voice through the Service.
- Any biometric-data obligations that apply in your jurisdiction. As described in our Privacy Policy, the Service does not create or store persistent voiceprints or biometric identifiers, but you remain responsible for your own compliance.
You agree to indemnify us for claims arising from your failure to obtain required consents (see Section 12).
6. Subscriptions, Billing, and Refunds
- Pricing: Pricing is provided through a written order form or sales agreement. Contact sales@polished.cx for current pricing.
- Billing cycle: Subscriptions are billed monthly or annually in advance, with usage-based fees (where applicable) billed monthly in arrears.
- Free trial: Trials or proofs of concept, where offered, are governed by the written terms provided at the time. At the end of a trial, the Service stops unless you convert to a paid subscription.
- Auto-renewal: Subscriptions auto-renew for successive terms equal to the initial term unless either party gives written notice of non-renewal at least 30 days before the end of the current term.
- Cancellation: You may cancel a subscription in accordance with your order form. Cancellation takes effect at the end of the current paid term.
- Refunds: Fees are non-refundable except as required by law.
- Taxes: Prices exclude applicable taxes, which are your responsibility where applicable.
- Late or failed payment: We may suspend the Service for accounts with overdue balances after providing reasonable notice.
7. Intellectual Property
- Our IP: The Service, including its software, models, design, and branding, is owned by us or our licensors and is protected by law. These Terms grant no ownership rights in the Service.
- Your Content: You retain ownership of Content you submit. You grant us a worldwide, non-exclusive license to process your Content solely to provide, secure, and operate the Service for you. We do not use your Content to train general-purpose AI models.
- Output: As between you and us, you may use Output produced from your Content for your business purposes. AI Output may not be unique to you, and similar Output may be produced for other users from different inputs.
8. Third-Party Services
The Service may rely on or integrate with third-party services (for example, AI model providers, telephony platforms, CCaaS systems, and payment processors). Your use of those services may be subject to their own terms, and we are not responsible for them.
9. AI Output Disclaimer
The Service uses AI to process and generate voice and text Output, including accent localization, noise removal, translation, and voice preservation. AI Output may be inaccurate, incomplete, or unsuitable for a given purpose, and translation accuracy can vary by language pair and acoustic conditions. You are responsible for reviewing Output before relying on it. The Service does not provide professional advice of any kind (legal, medical, financial, or otherwise).
10. Service Availability and Warranty Disclaimer
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we do not warrant that latency, accuracy, or quality targets described in marketing materials will be met for every call. Specific service-level commitments, if any, are set out in your order form.
11. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, or your breach of these Terms - including any failure to obtain required consents for voice processing.
13. Termination
We may suspend or terminate your access at any time for breach of these Terms or as otherwise permitted. You may stop using the Service at any time. Provisions that by their nature should survive termination (including IP, disclaimers, liability limits, and indemnity) will survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to arbitration under your order form.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date. For material changes, we will notify account holders by email or in-product notice before the changes take effect. Continued use after changes take effect constitutes acceptance.
